Once you have chosen a vehicle you would like to place a bid
on or purchase from stock selection, we will make a bid on your
behalf or make a purchase request and supply all information
needed to import your vehicle from Japan to your choice of port
Southampton or Liverpool. We will advise you on how and when
to pay the auction house, shipping and customs and excise. You
must collect your vehicle yourself from the docks and arrange
for your vehicle to be registered by yourself. (We will still
be here to offer advice on the quickest and cheapest way for
you to do this)
2. Platinum Service £1150 + V.A.T
Once you have chosen a vehicle you would like to place a bid
on or purchase from stock selection, we will make a bid on your
behalf or make a purchase request once you have won a bid or
purchased a stock vehicle we will advise you when to make payments
to all suppliers involved, after this stage you do nothing we
will arrange for your vehicle to be collected from Southampton
docks convert the Speedo to m.p.h and fit your rear fog light
arrange for M.O.T and e/s.v.a tests and finally register and
valet your vehicle ready for collection from us in Southampton,
or home delivery if preferred?

*** E/S.V.A test passes are not guaranteed and should any modifications
or repairs need to be carried out you will be liable for the
costs involved as well as any re-tests.
3. Kiki Cars Ltd act as agents ONLY for the purchase of your vehicles from the Japanese auction halls.
4. Kiki Cars Ltd will advise on the condition
of the vehicles at auction by explaining the information provided
on auction reports from the Japanese halls and accept no liability
for incorrect or misleading information that has been translated
incorrectly from Japanese to English.
5. "We" (and related expressions like "Us" and "Ours") refers to Kiki Cars Ltd.
6. "You" (and related expressions like "your",
"client", "clients") refers to you the customer who has approached
Kiki Cars Ltd and wishes to purchase a vehicle using our services.
7. A deposit of £300 + VAT (£352.50 inc VAT) is required to be made payable to Kiki Cars Ltd before we can forward any of our customers bids to Japan.
8. The deposit of £300 + VAT (£352.50 inc VAT) can be paid by credit or debit card on the day you wish to place a bid on a vehicle.
9. The deposit is ONLY refundable if your bid on a vehicle was unsuccessful at auction. We can however hold your deposit and place another bid on a vehicle which meets your requirement at another time.
10. If a bid is successful your deposit of £300 + VAT (£352.50 inc VAT) will be retained by Kiki Cars Ltd as full payment under Gold Service or first payment under Platinum Service. The second payment under Platinum Service must be paid in full within 7 days from receiving an invoice from Kiki Cars Ltd, this will be sent to you within a week of the car arriving at Southampton Docks.
11. After receiving an email or telephone call
from us at Kiki Cars Ltd notifying you of your successful purchase
and payment details to Japan, you MUST pay all amount owing
to Japan by telegraphic transfer with 5 days. All moneys MUST
be sent in Japanese YEN not British Pound Sterling (GBS). You
will need to pay all bank charges for this process.
12. If you fail to pay any amount to us, Kiki Cars Ltd, the Japanese Auction Halls or any other Third parties that we made arrangements with on your behalf, then we will issue a notice of Non-Payment. If payment is not received within 7 days of this notification being received by you then we are entitled to retain your deposit and sell your vehicle in order to recover our losses. If we are unable to fully recover our losses through the sale of your vehicle we may choose to issue legal action in order to recover any outstanding debts in which you owe Kiki Cars Ltd.
13. Once an "Auction Self Search Form" has
been submitted to us, it becomes a legally binding contract
between you and us and is an indication that you have fully
read and understood our Terms and Conditions.
14. Once payment for the vehicle shows as cleared funds in the Japanese Auction Halls account, we will arrange shipment for your vehicle to your chosen port (only available for Gold Service). The shipping company will contact you directly with notification of payment owing to them.
15. We arrange for all vehicles to be covered under Marine Insurance for the total loss. If you do not require this, please notify us before any bids are placed.
16. We accept no responsibility or liability for late deliveries or vehicle damage from the shipping company or agent.
17. If you choose our Gold Service we will
forward all paperwork to you by Recorded Post to the address
in which you have provided us with. We will also forward the
necessary documents to a Customs Clearing Agent before sending
them onto you so they can arrange your vehicle to clear customs,
you will then receive an invoice from them in which you will
need to pay and allow 24 hours payment clearance before being
able to collect your vehicle. Registration of your vehicle and
any necessary tests, fitting of parts must be organised/carried
out by yourself and NOT Kiki Cars Ltd.
18. If you choose our Platinum Service then
you must pay all amount owing when we advise you to. We will
organise/arrange for your vehicle to be collected from the Southampton
Docks. We will also arrange for any work and fitment of parts
to be carried out to meet UK legislation by third parties. We
will register your vehicle with the DVLA , providing we have
received from you an Insurance Certificate with your details
on. The car will need to be insured by the Chassis Number in
which we will provide you with.
19. M.O.T test and pass certificate guarantee is only available under Platinum Service and is for vehicles with an Auction Grade of 4 and above. This service is provided by us and means we will pay for the necessary repairs to obtain an M.O.T Pass Certificate. This excludes the following repairs: Wheels and or Tyres, and any repairs which will total above the cost of £600. We hold the right to refuse the service to you at any point if we wish to and will advise you of this before you bid on a vehicle.
20. E/S.V.A test and passes are not guaranteed.
You are liable for any modifications, repair work or re-tests
costs which may occur. We will advise you of this before any
work is to be carried out on your vehicle.
21. All Vehicle after 1997 will require
a model report for the E.S.V.A tests. Should a vehicle not
have a report available you would need to have one manually
made. We can give you details of contacts you can provide
you with guide costs for this and it is then your decision
as to if you would like to go ahead and continue a purchase.
Kiki Cars Ltd accept no liability for any vehicles purchased
requiring model reports which are not available.
22. Kiki Cars Ltd will ensure the information
presented to you is correct to the best of our abilities.
Any information in which we are dependant on from third parties
such as Shipping Agents and Auction Sheets, we cannot assume
responsibility for any of their errors.
23. We shall not be liable for any consequential
loss to your vehicle caused by shipping, any third parties
or any caused by breech of contract by us.
24. Any disputes arising out of this agreement
shall be subject to the jurisdiction of the Courts of England
and Wales. This contract is subject the Law of England and
Wales.
25. If any part of these terms and conditions
are found to be unlawful, it shall not affect the validity
or enforceability of the remaining conditions.
26. If you enter into contracts with third
parties, then Kiki Cars Ltd accepts no liability for any loss,
damage or costs as a result of your contract. Kiki Cars Ltd
offer third party services such as M.O.T testing, E/S.V.A
testing, Shipping, Customs Clearing Agents, Vehicle Registration,
Vehicle Collection and delivery. As Kiki Cars Ltd are active
agents we will not be held responsible for late deliveries
or any other resulting costs incurred.
27. We will give you an estimated final UK
price of any successful vehicle bids but due to fluctuation
on currency rates and costs incurred this is an estimate ONLY.
28. If a vehicle has been purchased and there
is a defect not mentioned on the auction sheet then a claim
can be made by the customer direct to the Japanese Auction
Hall. There are two exemption clauses to observe, these are
listed below.
Claim Exemption Clause 1
Any vehicle which may fit into any one of the following categories
will be made exempt from any claims to the auction hall.
1. Those car which has been damaged and repaired
(or un-repaired).
2. Those car which has done a mileage of
over 100,000 km.
3. Those car which has been purchased below
the price of Yen 200,000
4. Those car which has been first registered
more than ten years ago.
Please make sure to read the contents of the auction sheet
thoroughly and select your car with care.
Claim Exemption Clause 2
There are certain aspects of the car such as it's clutch condition
or braking ability that cannot be checked at the auction hall
(as there is no room to drive or move the car at the auction
hall). Although these aspects of the car are checked in out
after purchase checks, all auction rule states that any unmentioned
defects which can be repaired with a replacement parts cost
of under Yen 30,000 will be made exempt from any claims. In
case our staff spots any defect that is not mentioned in the
auction sheet, we will inform you the contents of the defects
by e-mail. In case the defect is suspected to be of a serious
nature and you wish to claim it to the auction hall, then
the car must first be bought into an authorised car dealer
to find out the estimate of the cost for the repair work,
then we must claim it to the auction hall. The fees involved
in getting the estimate cost for the repair will not be covered
by the auction hall, hence must be covered by yourself.
In case the defect found at the after-purchase of the car
was of the nature which we could not have spotted at the auction
hall prior to the purchase, please note that we will not be
able to take any responsibility for that defect.
29. Kiki Cars Ltd is committed to protecting
our customer's privacy whilst using this website. Any information
we collect from you will be held by Kiki Cars Ltd registered
office. We do not sell, trade or rent any personal information
you give us to any third parties.
